Expungement is a court-ordered process that allows the sealing of a person's criminal record. Not every circumstance qualifies for expungement. People who take advantage of this option are not required to disclose an arrest on an academic application, employment application or rental property application. However, certain government agencies, law enforcement and criminal courts will have access to the sealed records.

• The incident, summons, complaint or any court case or information associated with it.

How Do I Know If I Can Expunge My Arrest Record?

Each jurisdiction places different restrictions on who can and who cannot have a record expunged. In Colorado, you must meet one of the following criteria to have your petition considered:

• You were not charged.
• Your case was dismissed.
• You were acquitted of all charges and have also been granted a court order to seal any record of the case.

Not every criminal matter can be petitioned for expungement. For instance, a DUI, DWAI, certain traffic violations and a conviction cannot be sealed.
