An Automatic Criminal Restraining Order

Following an arrest for domestic violence, the court will automatically issue a restraining order that stays in effect for approximately 72 hours after your release. This restraining order prohibits you from having any contact with your accuser or any witnesses.

Civil Orders for Protection

An alleged victim of domestic abuse or assault has the option to request a temporary or permanent civil order for protection. If granted, you will be faced with specific restrictions that hinder your lifestyle, including:

  • You must stay at least 100 yards away from your accuser at all times
  • You cannot contact your accuser in any way
  • You will not be allowed to own a weapon
  • You will not be allowed to return home
  • You will not be able to see your children
  • You will not be treated equally in a divorce or child custody hearing

If a temporary restraining order becomes permanent, you will be required to follow these restrictions for the remainder of your life. Violation of these orders will result in serious legal consequences, including incarceration.
